Authenticity Guarantee

Last Updated: September 2025

This Authenticity Guarantee & Warranty Disclaimers Policy ("Policy") explains our commitments to product authenticity and outlines important warranty disclaimers for purchases from New York Watch Outlet. Double M Merchandise Inc. (d/b/a New York Watch Outlet) (referred to as "New York Watch Outlet," "we," "us," or "our") stands behind the authenticity of every item we sell, while also making clear what warranties or support (if any) are provided with your purchase. By purchasing a watch from our Site, you acknowledge and agree to the terms of this Policy. If you do not agree with these terms, please refrain from making a purchase.

100% Authenticity Guarantee

We unequivocally guarantee that every watch we sell is 100% genuine and authentic, whether it is brand new, open-box, or a display model. New York Watch Outlet has a zero-tolerance policy for counterfeit goods – no fakes, no replicas, ever. We source our inventory only from reputable suppliers (such as authorized dealers, distributors, and trusted wholesalers) to ensure each item’s authenticity. Prior to sale, each watch may be inspected and verified for authenticity by our team.

Promise of Remedy: If a watch purchased from New York Watch Outlet is ever proven not authentic by the original manufacturer, we will refund your full purchase price, subject to the verification procedures outlined in the Authenticity Challenge Process below. This authenticity guarantee remains in effect for the timeframe described in that section, giving you peace of mind and assurance that you are getting a genuine product. (In short, if any item were found to be non-authentic by a credible authority, you get your money back – a commitment that builds trust and encourages customers to come to us for a resolution rather than pursuing legal action.)

Independent Seller (Not an Authorized Dealer)

New York Watch Outlet is an independent retailer of luxury watches. We are not an authorized dealer of any watch brand or manufacturer. Any trademarks, brand names, or logos mentioned on our website are the sole property of their respective owners and are used strictly for identification and description purposes. By disclosing our status as an unaffiliated seller, we ensure there is no confusion: we have no sponsorship or affiliation with the watch brands we sell. Purchasing a watch from New York Watch Outlet means you are buying from Double M Merchandise Inc. (d/b/a New York Watch Outlet), not from the watch’s manufacturer or an "authorized" franchisee. The watch brands do not endorse or sponsor our business, and we make no representation to the contrary. This disclaimer protects both our customers and our company by being transparent about our independent status and guarding against any trademark or affiliation claims.

No Manufacturer Warranty & No After-Sale Support

Because we are not an authorized dealer, manufacturer warranties are not provided or valid on any watches sold by New York Watch Outlet. Watch manufacturers typically honor their warranty only when a product is purchased through their official authorized network; as a result, any watch purchased through our store will not be eligible for warranty service or coverage by the original manufacturer. You should not expect to receive a manufacturer’s warranty card or free manufacturer service for any watch bought here – in other words, the manufacturer’s factory warranty does not apply to your purchase (this is a common condition when buying from any gray-market or independent watch dealer).

Additionally, New York Watch Outlet does not offer any in-house warranty or extended coverage on our products. We do not provide our own warranties, repair services, or lifetime maintenance on the watches we sell. In other words, we do not offer any form of after-sale support or servicing beyond the initial sale. Every watch is sold in the condition described (new or otherwise) and is guaranteed to be authentic and functional on arrival, but we do not promise ongoing service or repairs once the watch is in your possession. If the watch requires service or repair at any time after our return period (see Return Policy), the owner will need to arrange that independently (for example, through the manufacturer’s service center or a qualified watch repair service) at their own cost.

No Other Warranties (Sold "As Is")

Except for the express authenticity guarantee stated in this Policy and your rights under our return policy, New York Watch Outlet makes no other warranties, express or implied, regarding the watches sold. To the fullest extent permitted by law, we disclaim all implied warranties, including any implied warranty of merchantability or fitness for a particular purpose, beyond the limited assurances explicitly provided here. All products are provided and sold "as is" with no guarantee of performance or longevity after the sale. This warranty disclaimer is an essential condition of each sale. (Some jurisdictions do not allow the exclusion of certain warranties, so the above disclaimer may not apply to the extent prohibited by law. In any such case, our liability will be limited to the maximum extent permitted by applicable law. Where implied warranties cannot be entirely disclaimed, we limit their duration to the minimum period allowed by law – for example, up to the 30-day return period – to the extent permissible.)

"As-Is" Condition and Final Sale After 30 Days

All watches are sold in the described condition and are assumed to be in good working order upon delivery. Once the initial return window (30 days from delivery) has passed, your watch is considered sold "as is," with no further guarantees or warranties beyond this point. This means that after 30 days, all sales are final and the product’s ongoing condition becomes the owner’s responsibility. We will not accept returns, exchanges, or issue refunds beyond the 30-day return period, except in the specific case of an authenticity problem verified under our Authenticity Challenge Process (outlined below).

In practice, selling a watch "as is" after 30 days signifies that New York Watch Outlet disclaims any obligation for issues that arise later. For example, any normal wear-and-tear, battery depletion, or mechanical failures that occur after the return period are solely the buyer’s responsibility to address. We strongly encourage you to inspect and test your watch upon receipt and during the first 30 days of ownership. If you discover any functional defect or are dissatisfied for any reason, please utilize our return policy within that timeframe. Beyond the 30-day window, no claims will be honored for defects, damage, or dissatisfaction, absent a duly substantiated authenticity claim.

Exclusive Remedy After Return Period

Our standard 30-day return policy (see our separate Return & Refund Policy for details) is the exclusive remedy available to you for any issues with your purchase, except in the event of a proven authenticity issue under the conditions of our Authenticity Guarantee. In other words, after 30 days have elapsed, you agree that you will not initiate disputes or chargebacks for problems with the product (such as performance or condition issues), as the sale is considered final. The only exception to this final-sale rule is if the watch is determined to be non-genuine via the process described below, in which case a refund will be provided. By completing a purchase with New York Watch Outlet, you acknowledge and accept that beyond the return period, the watch is yours "as is" and no further refunds or exchanges will be available.

(Note: This finality of sale and exclusive remedy is a crucial protection for us as a business. It means that after the return window, you rely on your own insurance or resources for any issues, barring authenticity. We make this clear up front to prevent misunderstandings or post-purchase disputes.)

Authenticity Challenge Process

We are confident in the authenticity of our products; however, if you have credible reason to believe that a watch you purchased from New York Watch Outlet is not authentic, we offer an Authenticity Challenge Process to address your concern. This process is in place to protect our customers by ensuring any authenticity disputes are handled fairly and based on definitive evidence. Please note: frivolous or unsubstantiated claims will not be honored – an authenticity challenge requires formal proof from the watch’s manufacturer. By purchasing from us, you agree that this procedure is the exclusive means to resolve any authenticity concerns.

If you suspect an authenticity issue, you must adhere to all of the following steps for a challenge to be considered:

Initiate Within 90 Days: You must contact New York Watch Outlet within 90 days of the purchase date to initiate an authenticity challenge. This 90-day window extends well beyond our normal return period to give you ample time to verify the watch. However, claims made after 90 days from purchase will not be eligible for this authenticity guarantee. (If you have authenticity concerns, we encourage you to act promptly and within this timeframe.)

Obtain an Official Manufacturer Statement: To formally challenge a watch’s authenticity, you must provide a written report or letter from the watch’s manufacturer (or from the manufacturer’s authorized service center) clearly stating that the watch is not authentic. This documentation must come directly from the brand’s official authority, not from an independent appraiser or third-party dealer. For example, you may send the watch to the brand’s official service center for evaluation, or contact the brand’s customer service to obtain a letter on company letterhead. The report must include details identifying the watch (serial number, model, etc.) and an explicit statement that the item has been examined and found to be counterfeit or not manufactured by the brand. We will not accept authenticity claims based on the opinions of independent jewelers, watch forums, or appraisal services – it must be an official determination by the actual manufacturer or its authorized representative.

Verification of Documentation: Any report or letter provided as evidence will be independently verified by New York Watch Outlet. The documentation must be on official manufacturer letterhead or originate from an official brand email domain, and it must be verifiable through direct contact. We will confirm the report’s authenticity by contacting the manufacturer or service center directly (using official contact information) to ensure that the statement is legitimate and was in fact issued by them. No refund or resolution will be offered until we have verified the manufacturer’s findings through our own due diligence. This step is critical to prevent fraud or misinformation – it ensures that any claim of non-authenticity is backed by the brand itself and not by an unqualified source.

Return of the Watch: As part of the challenge process, we will likely request that you return the watch to us for inspection. (In most cases, the manufacturer’s service center will have already inspected the piece to issue their letter; however, we reserve the right to examine the item ourselves as well.) The watch must be returned to New York Watch Outlet in the same condition you received it, along with the manufacturer’s documentation. We will provide instructions for the return shipment and will secure the watch in our facility while the claim is being evaluated. No refund will be processed until the item is returned to us and all required documentation is in hand.

Resolution and Refund: Once all the above conditions are met, if the manufacturer’s investigation confirms that the watch is not authentic, New York Watch Outlet will issue you a full refund for the purchase. This refund will cover 100% of the original purchase price and any applicable shipping costs you paid. Refunds will be processed only after (a) the watch is back in our possession, and (b) the manufacturer’s report has been verified by us as authentic and conclusive. (We will typically refund via the original payment method unless otherwise agreed.)

If the authenticity claim is not substantiated: In the event that our verification finds the claim unproven or false (for example, if the manufacturer or service center indicates that the watch is genuine, or if the documentation provided cannot be confirmed as coming from the manufacturer), then no refund will be issued. We will communicate the result to you, and you will retain ownership of the watch. If we had taken possession of the watch during the review, we will return the same item to you (at your expense for shipping) in such case. Any misrepresentation or alteration of manufacturer documents in an attempt to falsely claim a watch is fake will be treated seriously and may constitute fraud.

This Authenticity Challenge Process is designed to give you confidence that in the extremely unlikely scenario you receive anything other than a genuine timepiece, you have a clear path to resolution. It also protects our business by ensuring that any authenticity dispute is grounded in official, verifiable evidence. By purchasing from New York Watch Outlet, you agree to follow this process as the exclusive means of resolving any authenticity concerns. We are proud of our 100% authenticity record and expect that this procedure will rarely (if ever) need to be used – but it is in place for your protection and ours.

Product Images and Descriptions

We strive to provide accurate and detailed product descriptions, specifications, and photographs on our website for each watch. You can expect that the watch you receive will match the model and condition described in the listing. However, please understand that minor variations in appearance or included materials may occur from time to time, and such variations are not uncommon in the watch industry. Factors like manufacturer packaging updates, batch differences, or sourcing channels can result in slight differences between the pictured item (or its listed details) and what you receive. These minor discrepancies do not affect the authenticity or core functionality of the product.

For clarity, here are examples of minor variations that might occur (and do not constitute a misrepresentation of the product you purchased):

Packaging: The watch may arrive with a different style of box or packaging than pictured. Manufacturers often update their packaging, or a watch might come in a generic watch box if noted (especially for open-box or display models). Rest assured, any variations in packaging will be mentioned in the product listing when known. A different box design or the absence of certain printed materials (e.g. an outer sleeve or brochure) does not affect the watch itself or its authenticity.

Tags & Manuals: The inclusion or style of hang tags, warranty booklets, or instruction manuals may vary. For instance, an open-box unit might not include a dealer-stamped warranty card, or a manual might be a photocopy or in a different language or edition. We try to note what is included with each watch, but small differences in paperwork or tags can occur and are considered normal.

Serial Numbers: All our watches have their original serial numbers intact (we do not sell watches with serials removed or defaced). However, the format or location of a serial number on the watch or its warranty card might differ from stock photos. Manufacturers sometimes use different serial number formats or placements over a production run. For example, a serial number might be engraved on the case back in one batch and on the lug in another, or the warranty card might display the number in a slightly different format. These are minor variations, and the serial will still match the brand’s records for authenticity.

Cosmetic Details: In rare cases, a watch model might undergo minor cosmetic revisions by the manufacturer that aren’t immediately evident in our photos. This could include a subtle difference in a logo, dial font, or clasp design between production years. We attempt to update our listings to reflect any known changes. Any such minor detail difference is inherent to the product and is not a sign of inauthenticity or error. The watch’s primary features and model specifications will be as advertised for the specific reference you ordered.

Despite these potential variances, the watch model you receive will be the exact reference you ordered – the brand, model number, movement, and advertised features will all match the description. We encourage customers to read the product listing carefully, including notes about condition (new/open-box/display) and included accessories. If you have any specific concerns about what is included with a watch (for example, “Does it come with the original warranty card or manual?”), please contact us before purchase and we’ll be happy to clarify.

New York Watch Outlet is not liable for insubstantial differences or normal variability in product presentation. Slight deviations in packaging or documentation are not considered “Significantly Not As Described” so long as the watch itself is correct and authentic. We make every effort to be transparent and accurate, and we appreciate your understanding that stock photos and manufacturer specs sometimes allow for minor differences.

Product Safety and Use Warnings

We are committed to not only selling authentic products, but also to providing necessary safety information and disclaimers regarding the use of our watches. While wristwatches are generally safe consumer products, they do contain small components (such as button-cell batteries) and are intended for use by adults. To ensure full legal compliance and to promote safe use of our products, please heed the following safety notices:

Not a Toy – Keep Away from Children: Our products are not toys and are not designed or marketed for young children. Watches and their components (including removable links, clasps, and especially batteries) should be kept out of reach of children. Unsupervised children should not be allowed to play with or wear the watches. We do not sell products intended for anyone under the age of 13, and our website is not directed to children. Warning: If a child obtains a watch or any small part of it, there is a risk of accidental injury or ingestion. Do not allow children to handle the watch or its battery without adult supervision. (For example, even novelty “slap bracelet” watches for kids have been recalled due to battery ingestion hazards.) If you are purchasing a watch as a gift for a minor, please ensure an adult supervises its use, particularly with regard to the battery and small parts.

Battery Ingestion Hazard: ⚠️ WARNING: Watches contain small batteries (button-cell or coin batteries). Swallowing a coin-cell battery can be very dangerous, potentially causing severe injury or death to young children. Always keep watches and loose batteries away from infants, toddlers, and pets. If a battery is suspected to have been swallowed or lodged in any part of the body, seek immediate medical attention. The chemical reaction from an ingested battery can cause serious internal burns in as little as two hours. We are providing this warning in compliance with U.S. consumer safety recommendations and federal law, and to ensure our customers are aware of the risk. Always dispose of used batteries properly and store new batteries securely out of reach.

Battery Handling and Replacement: If you need to replace a watch battery, exercise caution. Do not leave a button-cell battery unattended during replacement – perform battery changes on a surface and in a setting where children cannot access the battery. After removing a spent battery, promptly dispose of it in a safe manner (tape the sides and follow local battery disposal guidelines) to prevent accidental ingestion by children or pets. When inserting a new battery, ensure the watch’s battery compartment is properly secured (most watch backs require a tool or screws to open, which provides some safety). We also advise against handling batteries with your bare hands excessively; use tools where appropriate and wash hands afterward, as batteries may contain trace chemicals.

California Proposition 65 Notice (California Customers): ⚠️ WARNING: This product may contain chemicals known to the State of California to cause cancer, birth defects, or other reproductive harm. This warning applies to any watch or watch accessory we sell that contains materials on California’s Prop 65 list (for example, certain battery chemicals, or alloys in watch bands, or leather strap dyes). We provide this notice in compliance with California law to ensure customers are informed. For more information on Proposition 65 chemicals, please visit the official Proposition 65 website. If your order is shipped to California, you may also find a Prop 65 warning label included with the product packaging. (Many electronics and watch products contain one or more trace chemicals on the Prop 65 list, even if there is no significant exposure during normal use. We include this caution to be thorough and legally compliant.)

Use at Your Own Risk – Proper Use Disclaimer: By using our products, you agree to use them as intended and according to instructions. Consumers are responsible for the proper use and care of the watches. New York Watch Outlet is not liable for any damage or injury resulting from misuse of the products. For example, we are not responsible for injuries resulting from wearing a watch in inappropriate situations (such as a non-waterproof watch being submerged), or allergic reactions to watch materials, or other misuse. Please follow any care guidelines provided by the manufacturer (such as water resistance limits, magnetism warnings, etc.). If you know you have skin sensitivities (e.g. a nickel allergy to certain stainless steels), take appropriate precautions. In short, once the product is in your hands, use it safely and responsibly. We provide these notices out of an abundance of caution and in line with industry best practices to ensure you are aware of potential risks and how to avoid them.

Why these safety notices? Small components like batteries pose rare but serious hazards if handled improperly, and California law mandates certain disclosures. Including these warnings demonstrates our diligence and helps shield us from liability: we have clearly informed customers of any known risks. Furthermore, as of 2024, federal law (Reese’s Law) requires strict safety standards for products containing button-cell batteries, including child-resistant battery compartments and prominent warning labels on packaging. By adhering to these requirements and communicating warnings, we are complying with U.S. product safety regulations and protecting our customers.
